General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to the use of the online tool milchrechnung.at. The operator is Rudolf Bohrer GmbH, Spengergasse 37/2, 1. Stock, 1050 Wien, Austria (hereinafter "Operator"). By using the tool you accept these terms.

§ 2 Service description

milchrechnung.at is a free online tool for checking, viewing, converting and creating electronic invoices in the formats Factur-X, ZUGFeRD, PEPPOL BIS Billing 3.0, ebInterface and XRechnung. The tool is provided without any claim to continuous operation, completeness of supported formats or freedom from errors.

§ 3 Costs

The use of milchrechnung.at is free of charge. No contractual relationship with a payment obligation arises. The Operator reserves the right to make the service wholly or partly subject to a charge in the future, or to discontinue it; existing uses will not be affected retroactively.

§ 4 No warranty / disclaimer of liability

The tool is provided "as is". The Operator accepts no warranty for the accuracy, completeness, legal conformity or fitness for a particular purpose of documents produced, checked or converted by the tool. Documents created or checked with milchrechnung.at must be independently validated by the user before any official or legally effective use.

Liability of the Operator for damages arising from the use or non-use of the tool is — to the extent permitted by law — excluded. This does not apply to damages resulting from injury to life, body or health, or to damages caused by intentional or grossly negligent conduct on the part of the Operator.

§ 5 Availability

There is no entitlement to uninterrupted availability of the service. The Operator may suspend the tool at any time for maintenance, modify its content or discontinue it entirely, without any claims arising therefrom.

§ 6 Rights of use and permitted use

Users may use the tool for their own purposes, including commercial purposes. Automated or mass use (e.g. via scripts or bots) that impairs or disproportionately burdens the operation of the service is not permitted. The Operator may block abusive use without prior notice.

§ 7 Data protection

§ 8 Applicable law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for disputes with commercial entities is Vienna, to the extent permitted by law. For consumers, the mandatory statutory rules on jurisdiction apply.
